Partner Program Terms & Conditions

These Terms govern participation in the Wesden Partner Program (the “Program”), operated by 11 Photo, LLC. (“Wesden,” “we,” “us”), 2255 Glades Rd, Suite 122-A, Boca Raton, FL 33431. By applying to or participating in the Program, you (“Partner,” “you”) agree to these Terms.

1. Who the Program is for

The Program is designed for architects, interior designers, landscape designers, home stagers, and other professionals who specify artwork for clients.

To participate you must:

  • Be at least 18 years old
  • Have a legitimate professional practice, portfolio, or business presence
  • Provide accurate and complete information in your application
  • Comply with these Terms and with all applicable laws

We review every application individually and may approve or decline any application at our sole discretion, with or without stating a reason.

2. How referrals are tracked

On approval you receive a unique referral link and referral code. A sale is credited to you when a customer reaches wesden.us through your link, or applies your code at checkout, and completes a purchase.

  • Attribution window: 90 days from the customer’s click
  • Last-click attribution: if a customer arrives through more than one partner, the most recent partner is credited
  • Tracking depends on the customer’s browser accepting cookies. We cannot credit referrals that our tracking does not record.

3. Commission

  • Commission rate: 10% of the eligible order value
  • Commission is calculated on the product subtotal only. Shipping and sales tax are excluded.
  • Commission is earned when an order is placed and becomes payable after the return window has closed and the order has not been refunded, cancelled, or charged back.
  • Refunded, cancelled, or fraudulent orders earn no commission. If commission has already been paid on such an order, we may deduct it from future payouts.
  • Self-referrals are not eligible. Orders placed by you, your business, or your household do not earn commission.

Pricing. Wesden does not discount. The price is the same through every path, and your commission never appears on your client’s invoice or changes what they pay.

4. Payment

  • Minimum payout: US$50
  • Payment schedule: monthly, within 15 days of the end of the month in which the commission became payable
  • Method: Venmo, PayPal, or Zelle

Balances below the minimum roll over to the following month. You are responsible for providing accurate payment details, and we are not liable for payments sent to details you supplied incorrectly.

Tax. Partners are independent contractors, not employees, agents, or representatives of Wesden. You are responsible for your own taxes.

  • US persons must submit a valid Form W-9 before any payout. If we pay you $600 or more in a calendar year, we are required to report it on Form 1099-NEC.
  • Non-US persons must submit the applicable Form W-8 before any payout.
  • We may withhold payment until valid tax documentation is on file.

5. Required disclosure

US law requires you to disclose your material connection to Wesden whenever you recommend our work publicly.

  • Disclose clearly and prominently, close to the recommendation itself — not buried in a bio, a footer, or behind a “more” link
  • Plain language is fine: “I earn a commission on Wesden works I specify”
  • This applies to social posts, stories, newsletters, blog posts, videos, and client-facing materials

You are responsible for your own compliance with the FTC Endorsement Guides. Failure to disclose is grounds for immediate termination and forfeiture of unpaid commission.

6. What you may not do

You may not:

  • Bid on “Wesden,” misspellings of it, or our product titles in paid search, or use them in display URLs
  • Represent yourself as Wesden, or imply that you are an employee, agent, or the artist
  • Publish your referral code on coupon, deal, cashback, or discount-aggregator sites
  • Send unsolicited email, SMS, or messages promoting Wesden
  • Make claims about the work, the materials, the edition, or the studio that we have not published
  • Alter, crop, filter, or re-edit our photographs, or remove attribution
  • Use our images to promote anything other than Wesden work
  • Register domains, social handles, or app names containing “Wesden”
  • Buy through your own link to earn commission on your own purchase
  • Promote Wesden alongside content that is unlawful, discriminatory, sexually explicit, or otherwise likely to damage the brand

7. Use of our materials

We grant you a limited, non-exclusive, revocable, non-transferable licence to use the images, text, and marks we make available in the partner portal, solely to promote Wesden during your participation in the Program.

You acquire no ownership. All rights in the photographs remain with the artists and with Wesden. The licence ends automatically when your participation ends, and you must stop using the materials.

8. Ending participation

Either party may end participation at any time, for any reason, with written notice.

We may suspend or terminate immediately, and withhold unpaid commission, if we reasonably believe you have breached these Terms, engaged in fraud, or acted in a way that damages the brand.

On termination you must remove your referral links and stop using our materials. Commission properly earned before termination remains payable, subject to Section 3.

9. Changes

We may update these Terms. Material changes will be communicated by email to the address on your partner account and take effect 30 days after notice. Continued participation after that date means you accept the updated Terms.

10. Disclaimers and liability

The Program is provided “as is.” We do not guarantee any level of traffic, sales, or earnings.

To the maximum extent permitted by law, our total liability arising out of the Program is limited to the total commission paid to you in the two months before the claim.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida.
